Hello, This is a very important question, and it's essential to understand the rules correctly to ensure your legal stay and work status in Poland. The situation for a foreigner who loses their job is specific and has certain deadlines. Here's a breakdown of the key points: The 30-Day Rule for Temporary Residence and Work Permit If you hold a temporary residence and work permit (zezwolenie na pobyt czasowy i pracę), which is the most common permit for working foreigners, the following applies: Notification Obligation: You (and your employer) must inform the Voivode (provincial governor) who issued your permit about the loss of your job. The deadline for this notification is 15 working days from the date your employment was terminated. Grace Period: After you notify the Voivode, your temporary residence and work permit will remain valid for 30 days from the date of job loss. This 30-day period is your "grace period" to find a new job and apply for a new permit. Consequences: If you do not find a new job and submit an application for a new temporary residence and work permit (or a change of the existing one) within this 30-day period, your permit may be withdrawn, which could lead to your stay becoming illegal. It's important to note that the 15-day notification obligation is considered fulfilled if you submit an application for a new permit (or a change of the existing one) within that timeframe. The Case of Graduates from Polish Universities Your previous status as a full-time student is a crucial detail. Graduates of full-time studies in Poland from a Polish university often have a more favorable legal status regarding work. Exemption from Work Permit: Graduates from Polish full-time university studies are exempt from the requirement to hold a work permit. This means that if you have a valid residence permit (e.g., a temporary residence card) and a diploma from a Polish university, you can work without a separate work permit. "Access to the Labor Market": If your residence card has a note "access to the labor market" (dostęp do rynku pracy), you can generally change jobs without having to apply for a new permit for each employer. However, this does not mean you can ignore all obligations. If your residence permit was granted for the purpose of work with a specific employer and it lists that employer's details, you still need to follow the 30-day rule mentioned above. Summary and Key Takeaways The general rule for a foreigner with a temporary residence and work permit is that you have 15 working days to notify the authorities about losing your job and then a 30-day grace period to find a new job and apply for a new permit. Your situation as a graduate of a Polish university may provide you with an exemption from needing a work permit, but you must still ensure your residence permit is valid. The most important thing is to check the specifics of your current residence card. Does it explicitly name your employer? Does it have a note about "access to the labor market"? For your specific case, I strongly recommend that you: Carefully review your residence card and the decision document you received when your permit was granted. Contact the local Voivodeship Office (Urząd Wojewódzki), specifically the Department for Foreigners (Wydział Spraw Cudzoziemców), for clarification on your specific situation. Seek legal advice from an immigration lawyer or a non-governmental organization that provides legal assistance to foreigners. This is the most reliable way to ensure you are taking the correct steps to protect your legal status in Poland. I hope this helps you understand your situation better. Please act quickly to avoid any potential issues with your legal stay in Poland.
